Contaminated Land Special Sites
Certain types of contaminated land (as described in Regulation 2 of the Contaminated Land (England) Regulations 2006 are required to be designated as special sites. The effect of this is that the Environment Agency becomes the enforcing authority (rather than the Local Authority) and assumes responsibility for requiring remediation to be carried out under section 78E of Part 2A of the Environmental Protection Act 1990 (Part 2A).
